A delivery driver has been awarded $50 million in a lawsuit following severe burns sustained when a Starbucks beverage spilled in his lap at a drive-through in California, according to court documents.
On Friday, a jury in Los Angeles County ruled in favor of Michael Garcia, who required skin grafts and various medical procedures on his genitals after a venti-sized tea drink spilled moments after he received it on February 8, 2020. His attorneys reported that he has endured permanent and life-altering disfigurement as a result of the incident.
Garcia's lawsuit claimed negligence on the part of Starbucks, asserting that an employee failed to secure the hot tea adequately in the takeout tray.
"This jury verdict represents a significant step in holding Starbucks accountable for its blatant disregard for customer safety and its refusal to take responsibility," stated Nick Rowley, one of Garcia's attorneys.
In response, Starbucks expressed sympathy for Garcia but announced plans to appeal the verdict.
"We disagree with the jury's conclusion that we were responsible for this incident and consider the damages awarded to be excessive," the Seattle-based coffee company stated in a press release, emphasizing its commitment to maintaining the highest safety standards in the handling of hot beverages.
U.S. restaurants have previously encountered lawsuits related to customer burns.
In a notable case from the 1990s, a jury in New Mexico awarded nearly $3 million to a woman who suffered burns while attempting to remove the lid from a cup of coffee at a McDonald's drive-through. A judge later reduced the award, and the case was ultimately settled for an undisclosed amount below $600,000.
There have also been instances where juries favored restaurants, such as in another 1990s case involving a child who accidentally spilled a cup of McDonald's coffee on himself in Iowa.
